These Terms of Service ("Terms") govern your use of the Pragmatic Mortgage website, borrower portal/dashboard, mobile applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
"Pragmatic Mortgage", "we", "us", and "our" refers to Paragon Pragmatic Lending operating under the Pragmatic Mortgage brand. We are a licensed mortgage brokerage in British Columbia and Alberta. We may expand to other provinces in the future, but we only provide regulated mortgage brokerage services where we are licensed.
We are not a lender. Lenders and insurers make their own approval decisions.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access. You must have authority to upload or share any documents you provide.
By using the Services, you consent to receive communications electronically (for example, email, in-app messages, or dashboard notices). Where applicable and permitted by law, you agree that electronic records and signatures are binding.
If you use the Services to start or manage a mortgage application, you authorize us to collect information, request documents, and communicate with lenders or insurers as needed to evaluate your application.
Credit checks are performed only with your authorization. If you authorize a credit check, you consent to us and/or a lender obtaining a credit report for mortgage-related purposes.

You retain ownership of the information and documents you submit ("User Content"). You grant us a limited license to host, store, process, and share User Content as needed to provide the Services and comply with law.
You represent that you have the right to provide User Content and that it does not infringe third-party rights. We may convert images to PDF and store PDF files only.
The Services, including text, graphics, logos, software, and content we create, are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the Services except as permitted by law.
The Services may link to or integrate third-party services (for example, scheduling tools, lenders, insurers, credit bureaus, mapping providers, analytics, or AI services). We are not responsible for third-party services or their privacy practices. Your use of third-party services is governed by their terms and policies.
Our Privacy Policy explains how we collect and use personal information. By using the Services, you agree to the Privacy Policy.
We may suspend or terminate access to the Services at any time if we believe you have violated these Terms or if required to protect users, the Services, or legal obligations.
The Services are provided "as is" and "as available" to the maximum extent permitted by law. We disclaim all warranties and conditions, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption. Our total liability for all claims relating to the Services will not exceed the greater of CAD $100 or the amount you paid to us for the Services in the 12 months before the event giving rise to the claim.
You agree to indemnify and hold harmless Pragmatic Mortgage and its directors, officers, employees, contractors, and agents from claims arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts located in British Columbia for disputes arising out of these Terms or the Services, except where consumer protection laws provide otherwise.
If you download or use our mobile app from the Apple App Store or Google Play, your use may also be subject to the applicable store terms. Apple and Google are not responsible for the Services except as required by law.
We may update these Terms from time to time. We will post the updated version and revise the last updated date above. Your continued use of the Services means you accept the updated Terms.
